Validity
Kind of Colors sells the pictures offered in the online shop to business/private customers subject to the following terms and conditions of delivery and sale (GTC)

Prices
The prices in the shop are shown in CHF including VAT.

Payment
Advance payment. We accept payments with all major credit cards (Visa, Mastercard, Amex)

Shipping
5 - 10 working days to process and ship your order. We generally ship worldwide. We ask that you contact us at buena.h@icloud.com to arrange shipping options.

For shipping charges, taxes and duties, you are required to pay them. If you refuse to accept the order, we will not refund the purchase price or the shipping charges, taxes and duties.
- We cannot guarantee delivery times.
- Once an order has been dispatched and is in transit the order cannot be cancelled.
- Shipping costs for returns and any costs incurred are the responsibility of the customer and are non-refundable.

Return policy
Returns within Switzerland and the rest of the world: You can return your purchased item within 5 days of delivery. Valid only with contact via buena.h@icloud.com with reasons for the return. Possible colour differences are to be accepted. Shipping costs etc. are at the expense of the customer.

Warranty
The right of the customer to reduce the purchase price is excluded. This exclusion of liability also applies to all claims competing with warranty rights. The warranty does not cover normal wear and tear, the consequences of improper handling or damage by the buyer or third parties, or defects caused by external influences.

Disclaimer
The content of the Kind of Colors website contains neither representations nor warranties. In no event shall Kind of Colors be liable (to the extent permitted by law) for any direct, indirect or consequential damages arising out of the use of the information and material on this website or any links to other websites.

Liability for third-party damage is also excluded. The amount of any claim arising from Kind of Colors' liability is also limited to the purchase price of the product sold.

Kind of Colors accepts no liability for the description of third parties, in particular customers in the context of customer reviews published in the online shop or our social media presence.

Severability clause
Should individual provisions of this contract, including these provisions, be invalid in whole or in part, or should this contract contain a loophole, this shall not affect the validity of the remaining provisions or parts of such provisions. The invalid or missing provisions shall be replaced by the respective statutory provisions.

Applicable law and place of jurisdiction
This agreement and all legal relations in connection therewith shall be governed by Swiss law. The United Nations Convention on Contracts for the International Sale of Goods (CISG) shall not apply.

The courts of Zurich, Switzerland, shall have exclusive jurisdiction over all disputes arising in connection with this agreement.
